Terms and Conditions and Release of Liability Western Kids Health – Professional Courses and Workshops Western Kids Health Pty Ltd

(“Western Kids Health”) offers both online and in-person workshops and courses (“Western Kids Health Courses”) that are designed for qualified healthcare professionals. These Courses provide training and instruction in physiotherapy, occupational therapy, paediatric rehabilitation, exercise-based therapy, and other health-related topics, as determined by Western Kids Health from time to time. By enrolling in a Western Kids Health Course, I hereby represent, acknowledge, and agree to the following:

  • I represent that I am a qualified health professional and an appropriate participant in this Course, which is designed solely for professionals with relevant training and registration.
  • I understand that, as a healthcare professional, I am solely responsible for my actions and clinical decisions in the treatment of patients.
  • I acknowledge that I must apply my own clinical reasoning when utilising any information presented in this Course.
  • I acknowledge that this Course is for educational and informational purposes only. It does not constitute medical advice and is not a substitute for professional consultation, diagnosis, or treatment. To the extent that I have accessed the Course through links provided via any Western Kids Health website or learning platform, I agree to any Terms of Use or Privacy Policies applicable to that platform.
  • I understand and agree that the Course materials and content are the sole property of Western Kids Health and are protected under copyright laws.
  • I agree not to copy, reproduce, modify, distribute, or share any course materials without prior written consent from Western Kids Health. This Course may be delivered through third-party platforms (e.g.  Zoom, or others).
  • I agree to abide by all applicable terms and conditions of these platforms as required.
  • In consideration for receiving the educational instruction provided in this Course, I waive and release Western Kids Health, its directors, employees, agents, contractors, and presenters from any and all liability, claims, damages, actions or causes of action, including but not limited to personal injury, loss of income, or damage to property, regardless of how caused, and whether in contract, negligence, or other legal theory, except in cases of wilful or gross negligence.
  • I understand and agree that this waiver constitutes a complete release of all current and prospective claims and applies even if Western Kids Health or its representatives are found to have acted negligently (other than in cases of wilful misconduct). If any part of this Release of Liability is held by a court to be invalid or unenforceable, I agree that the remaining provisions will remain in full force and effect.
  • I acknowledge that the Course content does not constitute an essential service, and that I could obtain similar training elsewhere.
  • I affirm that I am voluntarily participating in this Course and am under no physical, economic, or professional compulsion to enrol or accept these terms.
  • I understand that I must always practice within the legal and ethical scope defined by my professional registration body.

By enrolling in this Course, I acknowledge that I have read, understood, and agree to the above Terms and Conditions and Release of Liability.
